Abstract

With the rapid development of artificial intelligence technology, the large-scale scraping and use of copyright-protected works during the training process of AI models has triggered widespread legal disputes. The fair use principle, as the core mechanism within copyright law for balancing the incentive for creation and the public interest, faces unprecedented interpretive tension in the context of artificial intelligence. This paper will examine the rules and limitations of the fair use system within China’s Copyright Law and related guiding opinions.
